Acceptance of Terms

By accessing this website or placing an enquiry with ASIF TRADERS, you agree to be bound by these Terms of Service. They apply to all enquiries, quotations, orders and supplies of building materials made through this website, over WhatsApp, by telephone or at our office at Digha, Thane-Belapur Road, Navi Mumbai. If you do not agree with these terms, please do not use the website or place an enquiry. These terms apply together with the final quotation issued for your order; where the final quotation states something different, the final quotation prevails.

Product Availability

Products displayed on the website are subject to availability. Website listings do not guarantee that a product is physically available in stock. Availability, brand and quantity are subject to confirmation by ASIF TRADERS. Several categories, including non-stocked cement brands, TMT bars, structural steel, tiles, blocks and aggregates, are arranged against a specific requirement. If an item cannot be supplied within your timeline, we will inform you and, where possible, suggest an alternative grade, brand or size.

Quote Requests & Order Confirmation

Adding products to the quote cart or submitting a quote request does not create a confirmed order or any binding obligation on either party. An order becomes confirmed only after the final quotation is accepted and ASIF TRADERS confirms the order and the applicable payment terms, by email, WhatsApp or another written channel. Until that confirmation, prices, availability, quantities and delivery timelines remain indicative, and we may revise or decline a requirement.

Pricing, Taxes & Charges

Prices shown on this website are indicative and are provided for general reference only. The final price payable, applicable GST, freight and transport charges, loading or unloading charges, and any other applicable charges will be as specified in the final quotation issued for your order. Prices may change without prior notice due to supplier pricing, market fluctuations, grade or brand availability, freight revisions, statutory levies or changes in duties. Unless stated otherwise, a quotation is valid for 7 days from its date of issue. A GST invoice is issued for every supply; our GSTIN is 27DZOPS9659P1ZR.

Specifications, Brands & Images

Product images, descriptions and grade information on this website are for illustration and general guidance. Actual shade, finish, dimensions, packing and brand may vary by batch, plant or supplier. For each order, the specifications, grades, quantities and brands stated in the final quotation are the controlling description of what will be supplied. Where material is supplied as per the grade or brand named in the final quotation, minor variation in shade, packing or batch does not by itself amount to a defect.

Quality & Manufacturer Warranty

Materials we supply are manufactured and packed by third-party manufacturers, and their quality is governed by the applicable Indian Standards and by the manufacturer's own declarations. Where a product is covered by a manufacturer warranty, the applicable manufacturer warranty terms will apply, and any warranty claim is to be taken up with the manufacturer as per those terms. ASIF TRADERS does not provide a separate warranty in respect of the material supplied unless expressly stated in writing in the final quotation. Nothing in this clause excludes or limits any right, remedy or statutory protection that cannot be excluded or limited under applicable law, including any protection available under the Consumer Protection Act, 2019 where it applies.

Delivery Timelines

Delivery timelines shown on this website, including any reference to 24-48 hours, are estimates of typical timelines only. They are not a guaranteed delivery commitment. Delays may occur due to stock availability, supplier delays, transportation, traffic, weather, site access, customer-related delays and other circumstances beyond our reasonable control. The delivery areas named on this website, such as Navi Mumbai, Thane and adjoining areas, indicate where we normally supply; they are not a commitment to a particular date or time slot. Any transport, freight or unloading charges and any special delivery arrangements are as stated in the final quotation.

Customer & Site Responsibilities

For deliveries to a construction site or project location, the customer is responsible for: (a) providing accurate delivery details, including the full address, landmark, contact person and a reachable telephone number; (b) ensuring suitable and safe site access for the delivery vehicle at the scheduled time; and (c) arranging adequate labour and equipment for unloading, unless unloading has been specifically agreed by us in writing. Where a vehicle cannot reach the delivery point, is detained at site, or is required to wait beyond a reasonable period, additional charges may apply as stated in the final quotation or as mutually agreed. Risk in the material passes to the customer when it is delivered at the agreed delivery point.

Cancellations, Returns & Claims

A requisition may be cancelled while material has not yet been procured or despatched. Once procurement, despatch or delivery arrangements for your order have started, cancellation may not be possible, and for bulk and construction materials specific restrictions on cancellation or return may apply as stated in the final quotation and in our Returns & Refunds Policy. Claims relating to damaged, short-supplied or incorrect material must be reported within the period and in the manner set out in the Returns & Refunds Policy, and are governed by that policy. Please read our Returns & Refunds Policy before accepting delivery.

Payment

Payments may be made by UPI, bank transfer, or cash where agreed in the quotation. Bulk and project orders may require an advance as specified in the quotation. Applicable taxes, freight and other charges will be stated in the final quotation and GST invoice. Customers should make payments only through payment details officially provided by ASIF TRADERS.

User Accounts

Where you create an account on this website (Login, Sign Up, Profile or My Quotes sections), you agree to provide accurate and current information, and to keep your login credentials secure and confidential. You are responsible for activity carried out through your account and must not use another person's account or allow your account to be misused. ASIF TRADERS may suspend or terminate an account, with or without notice, in case of misuse, suspected fraud, false information or violation of these Terms, subject to applicable law. You may contact us to correct account information or to request deletion of your account data, in accordance with our Privacy Policy.

Force Majeure

Neither party is liable for any failure or delay in performance caused by events beyond its reasonable control, including natural disasters such as flood, cyclone, heavy monsoon, earthquake or fire; extreme weather; strikes, bandhs, lockouts or labour unrest; transport disruptions, fuel or vehicle unavailability; supplier disruptions, plant shutdown or raw material shortage; government or statutory restrictions, orders, embargoes or permit delays; epidemics or pandemics; war, civil disturbance or act of God; and failure of utilities or communication systems. Where such an event occurs, the affected timelines are extended accordingly, and either party may cancel the affected portion of the order without liability in respect of the part that cannot be performed.

Limitation of Liability

To the extent permitted by law, ASIF TRADERS is not liable for indirect, incidental, special or consequential loss, including loss of profit, loss arising from delay in delivery, or loss arising from use of the material otherwise than in accordance with the manufacturer's or our specification. Our total liability in respect of any order is limited to the value of the material supplied under the relevant invoice. Nothing in these terms excludes or limits any liability, right or remedy that cannot be excluded or limited under applicable Indian law.

Final Quotation

The final accepted quotation is the controlling document for the applicable product or brand, quantity, price, GST, freight and transport charges, delivery timeline and payment terms. If there is any conflict or inconsistency between this website, any verbal discussion, or any other communication, and the final quotation, the final quotation prevails to the extent of that inconsistency. Matters not covered by the final quotation are governed by these Terms of Service.

Dispute Resolution & Governing Law

If a dispute arises in connection with an enquiry, quotation, order or supply, both parties will first attempt to resolve it in good faith through direct communication and, if required, an exchange of written correspondence, before taking any other step. If the dispute is not resolved within a reasonable period, either party may pursue it through the competent courts or any other legally applicable mechanism. Where a dispute-resolution mechanism has been separately agreed in writing, that mechanism will apply. These Terms are governed by the applicable laws of India, and disputes are subject to the jurisdiction of the competent courts at Navi Mumbai, Maharashtra, being the location of our principal place of business, unless a different jurisdiction is agreed in writing in the final quotation.

Changes to These Terms

ASIF TRADERS may update these Terms from time to time. The updated version will be published on this page with the effective/update date. Continued use of the website after an update constitutes acceptance of the updated Terms, subject to applicable law.
